What is a H-1B Visa?

In addition to sponsoring a foreign worker, an employer must file a petition for their employee with USCIS. An employer is defined as a person, firm, or corporation with an IRS tax identification number. The employer must also have a Federal Employer Identification Number.

To qualify for an H-1B visa, a foreign worker must have a bachelor’s degree or the equivalent degree, or three years of relevant post-graduate experience. An H-1B visa is valid for three years and can be extended twice as long as the original application is approved. An employer may apply for an extension of two or three years for the same position. In this way, they can stay in the U.S. for as long as they are needed. During their stay, they are allowed to work in a particular specialty for a total of ten years.
